Terms of Service

The terms, service-level guarantees, and operating standards governing The Flex Finance.

Standard Engagement Terms

Effective Date: October 19, 2026. These Terms of Service (“Terms”) govern the accounting, financial operations, and bookkeeping services provided by The Flex Finance (“Flex Finance”, “we”, “us”) to your company (“Client”, “you”).

1. Scope of Services & CPA Oversight

The Flex Finance provides CPA-supervised bookkeeping, multi-gateway clearing, and financial operations automation. All monthly financial statements (Balance Sheet, Profit & Loss, and Statement of Cash Flows) and corporate tax returns (Form 1120, 1120-S, or 1065) are reviewed, audited, and signed off under the authority of a licensed US Certified Public Accountant (CPA).

2. Month-to-Month Billing & ACH Payments

Unless explicitly modified by an Enterprise Custom Order Form:

  • Month-to-Month: All subscription plans (FlexBooks Core at $999/mo, Autonomous FinOps at $1,999/mo, and Enterprise ERP at $3,499/mo) operate on a month-to-month basis with zero long-term annual lock-in contracts.
  • Payment Method: Monthly subscription dues are billed automatically via ACH direct debit at the beginning of each billing cycle.
  • Cancellation Notice: Either party may cancel ongoing monthly services upon providing 30 days’ prior written notice.

3. Guaranteed 5-Day Close SLA

We guarantee that your monthly books will be reconciled, CPA-reviewed, and delivered within five (5) business days following the close of each calendar month, provided all required read-only bank feeds and vendor receipts are accessible. If we fail to deliver within this 5-day SLA due to our operational delay, that month’s service fee is credited 100% free of charge.

4. Client Responsibilities & Read-Only Access

To ensure timely reconciliation, Client agrees to:

  • Maintain active read-only OAuth connections to relevant accounting ledgers (QuickBooks Online or Xero), merchant gateways (Stripe, Shopify, PayPal, Payoneer), and commercial bank feeds.
  • Forward vendor bills and supplier invoices to their designated @theflexfinance.com inbox.
  • Respond in a reasonable timeframe to occasional unknown transaction queries submitted through the private WhatsApp or Slack channel.

5. Non-Custodial Disclaimer & Fund Movement

The Flex Finance is an accounting, bookkeeping, and fractional CFO firm, not a depository banking institution. We operate strictly on a non-custodial basis. Under no circumstances does The Flex Finance possess custody, control, or authorization over client cash, nor do we accept authorization to disburse funds, initiate wire transfers, or alter bank account beneficiaries.

6. Data Ownership & Offboarding Portability

Client retains 100% unencumbered ownership of all accounting data, general ledgers, historical journals, and financial statements. In our Core and Autonomous FinOps tiers, your data resides continuously inside your own QuickBooks Online or Xero ledger. If you choose to terminate services, your ledger remains completely intact and immediately operable without vendor lock-in.

7. Governing Law & Jurisdiction

These Terms and any dispute arising from services provided hereunder shall be governed by and construed in accordance with the laws of the State of New Jersey, United States, without regard to conflict of law principles.
